Regulatory Compliance Requirements and Case Studies of Cosmetics in the United States

In 2022, the United States was the largest market for Chinese cosmetics exports, accounting for 21.6% of China’s total cosmetics exports, with an export value of 1.24 billion US dollars, a year-on-year increase of 3.6%. The following countries are the United Kingdom, Japan, Thailand, Indonesia, Malaysia, the Netherlands, Australia, and the Philippines. In addition, 36.7% of the export volume is composed of other countries and regions.

On December 29, 2022, US President Biden signed and passed the Food and Drug Omnibus Reform Act of 2022 (FDORA Act), which included the much-anticipated Modernization of Cosmetics Regulation Act of 2022 (MoCRA) - the first major upgrade in US cosmetic regulations since 1938. This bill proposes significant revisions to the current Federal Food, Drug, and Cosmetic Act (FDC Act), aimed at modernizing cosmetic safety standards in the United States.

On August 7, 2023, the U.S. Food and Drug Administration issued draft guidance on cosmetic product facility registrations and product listings, as mandated by the Modernization of Cosmetics Regulation Act of 2022 (MoCRA). When finalized, the draft guidance will assist stakeholders with cosmetic product facility registration and product listing submissions to FDA, by describing who is responsible for making the registration and listing submissions, what information to include, how to submit, and when to submit, as well as certain exemptions to the registration and listing requirements.
